These terms are the rules for using MailAfter, in plain words. By creating an account or using the MailAfter Chrome extension you agree to them and to our Privacy Policy, which explains what we collect and why.

1. Who we are

MailAfter is operated by KLabs (“we”, “us”). Contact: support@mailafter.app.

2. The service

MailAfter tells you when emails you send from Gmail are opened. A Chrome extension adds a tiny image to the emails you send while MailAfter is switched on. When the recipient’s mail app loads that image, we record the open, and you see it in your dashboard and in the extension.

It is free while we launch. We may introduce paid plans later. We will tell you before any charge applies, and nothing is charged without your agreement.

3. Who can use it

You must be at least 16 years old (or older, if the law of your country sets a higher minimum age for this kind of service) and able to enter a binding agreement. MailAfter is not for children. If you use MailAfter for an organisation, you confirm that you may accept these terms on its behalf. You may not use MailAfter if the law forbids it in your country or if we have closed your account.

4. Your account and connection key

5. What MailAfter does, and what it cannot do

MailAfter detects an open when a mail app loads the tiny image. That has limits you should know about, so that you read the results correctly:

MailAfter does not read your message text or attachments, and it does not send emails for you.

6. Acceptable use

You may use MailAfter only for lawful, legitimate purposes. You must not use it, or let anyone else use it, to:

Fair-use limits apply (for example, a daily cap on new trackers and limits on sign-ups). The examples above are not a full list: anything unlawful, or likely to harm people or the service, is not allowed.

7. Your responsibility, and telling your recipients

You alone are responsible for how you use MailAfter and for what you do with the information it shows you. In particular, you are solely responsible for making sure your use is lawful where you and your recipients are, and for giving recipients any notice, and getting any consent, that the law requires before you track them. This applies in many countries, for example under the ePrivacy rules and the GDPR in the EU and UK. We do not send that notice for you, and we cannot check whether you have done so.

8. Your data

You keep ownership of your data: the details of the emails you track and the opens recorded for them. You allow us to process it only to provide the service, as described in the Privacy Policy. We do not claim any other rights to it, and we do not sell it.

9. Reporting misuse, and requests from authorities

If you think MailAfter is being used against you or against someone else, or you want to report any breach of these terms, write to support@mailafter.app with the details. We review reports and may act on them as set out in section 11.

We cooperate with law enforcement and courts only when we receive valid legal process, and we disclose only what that process legally requires.

10. Availability and changes

We work to keep MailAfter running, but we do not promise uninterrupted or error-free service. MailAfter depends on Gmail and Chrome, which can change without notice and may affect how it works. We may change, limit or discontinue features, and we will give reasonable notice of significant changes where we can.

11. Suspension and ending your use

You can stop at any time: switch tracking off or uninstall the extension, and delete your account in Settings (you can download your data first). Deleting your account removes your data as described in the Privacy Policy. Emails you already sent keep their tiny image, but once your account is deleted nothing is recorded for them.

We may, at our discretion and without notice, limit, suspend or end your access, and remove related trackers and data, if we suspect misuse, if you break these terms or the law, if needed to protect the service, other people or the law, or if we stop offering the service. Where we reasonably can and the law requires it, we will tell you and let you download your data. Sections that by their nature should continue (including 7 and 13 to 18 and 21) stay in force after your access ends.

12. Third parties

MailAfter is independent. Gmail, Google and Chrome are trademarks of Google LLC; MailAfter is not affiliated with, endorsed or sponsored by Google. If you connect Telegram, Telegram’s own terms apply to that service.

13. No warranty

The service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including any warranty of merchantability, fitness for a particular purpose, accuracy or non-infringement, to the extent the law allows. In particular, we do not promise that open information is complete or accurate (see section 5), that the service will be uninterrupted or secure, or that it will meet your needs.

14. Export and sanctions compliance

You confirm that you are not on any government list of restricted or sanctioned persons, that you are not in a country or region under comprehensive sanctions or an embargo that applies to us, and that you will not use or give access to MailAfter in breach of export-control or sanctions laws.

15. Limit of liability

To the extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive loss, or for lost profits, revenue, data, goodwill or business, however caused. To the extent the law allows, our total liability to you for all claims relating to MailAfter is limited to the greater of (a) the amount you paid us for the service in the 12 months before the event that gave rise to the claim, and (b) EUR 100.

Nothing in these terms limits or excludes liability that cannot be limited or excluded by law. This includes liability for death or personal injury, for fraud, for intentional wrongdoing or gross negligence, and your statutory rights as a consumer.

16. Indemnity

To the extent the law allows, you agree to defend, indemnify and hold harmless KLabs and the people who work for it from any claim, demand, loss, damage, fine, cost or expense (including reasonable legal fees) arising out of or relating to your use of MailAfter, your breach of these terms or the law, your failure to give required notice or get required consent, or your violation of anyone’s rights. We may take over the defence of any matter at your expense, and you will not settle it without our written consent.

17. Individual claims only

To the extent the law allows, you and we may each bring claims against the other only on an individual basis, and not as a plaintiff or class member in any class, collective or representative action. This does not limit rights that the law gives you and that cannot be waived, such as collective redress rights of consumers in the EU.

18. Governing law and disputes

These terms, and any dispute about them or about MailAfter, are governed by the law of the country where KLabs is established, without its conflict-of-law rules. The courts of that country have jurisdiction, except where the law gives you the right to go to another court. We will confirm the country in writing if you need it to bring or answer a legal claim. If you are a consumer, you keep the mandatory protections of the law of your country of residence and any right to bring a claim in the courts of that country.

19. Events beyond our control

We are not liable for any failure or delay in providing MailAfter caused by events beyond our reasonable control, such as outages of internet, hosting, Google, Chrome or Telegram services, power or network failures, cyber-attacks, natural disasters, war, terrorism, strikes, epidemics, or acts of government. We will resume the service as soon as we reasonably can.

20. Changes to these terms

If we change these terms in a meaningful way we will update the date above and, where appropriate, tell you in the product before the change applies. If you do not agree to a change, you can delete your account. If you keep using MailAfter after the change applies, you accept it.

21. General

22. Quick answers

Is MailAfter free?

Yes, while we launch. If we introduce paid plans we will tell you first, and nothing is charged without your agreement.

Can I rely on an “Opened” for something important?

Treat it as a strong hint, not proof. Some mail apps load images without anyone reading, and others block them. See section 5.

Do I have to tell my recipients?

Where the law requires it, yes. In many places, including the EU and UK, tracking people can require notice or consent. That duty is yours.

Can I leave and take my data?

Yes, any time. Download your data in Settings, then delete your account. Everything is removed as described in the Privacy Policy.

How old do I have to be?

At least 16, or older if your country requires it.

Can I use it to monitor a person?

No. Stalking, surveillance, harassment, spam, phishing, fraud and any unlawful tracking are forbidden, and we can suspend accounts without notice for suspected misuse. See section 6.

How do I report misuse?

Write to support@mailafter.app with the details. We review every report.

Is MailAfter connected to Google?

No. MailAfter is an independent product. It works with Gmail through your browser but is not made, endorsed or supported by Google.
